SIT probe into Gujarat riots challenged, SC to hear plea New Delhi: The Supreme Court today decided to consider an application seeking recall of its order handing over to SIT a complaint relating to 2002 Gujarat riots in which Chief Minister Narendra Modi has been named as one of the 63 accused.

The application in this regard was filed by the BJP MLA Kalubhai Maliwad who has also been made an accused in the complaint filed by Zakia Jaffry, wife of Congress leader Ehsaan Jafri who was killed in the riots at the Gulbarga society in Ahmedabad.

Eminent criminal lawyer Ram Jethmalani has moved the plea on behalf of the MLA in the apex court.

Modi was summoned by the SIT on March 21 in connection with the probe of the case. This move is being seen as an attempt by him to duck the probe.

Meanwhile, a three judge bench headed by Justice D K Jain asked the trial court in Ahmedabad to defer its hearing in the Gulburga society case.

The order to this effect was passed in view of a petition filed in Gujarat High Court seeking transfer of the case to another trial court judge.

Solicitor General Gopal Subramanium and senior advocate Harish Salve, who is assisting the court in the matter as amicus curiae, informed the bench that Special Public Prosecutor R K Shah has tended his resignation making certain allegations against the presiding officer (Judge) and the SIT.

I dont know why SIT is probing Mr Modi who is the Development face of India In the world.Please dont destablise Mr Modi by falsley implicating him for 2002 riot .we are giving free hand to lalu and others whom lots of pending case are there.If we want vibrant india then for all shake dont falsely implicate and destablise Mr Modi.
