Allahabad: The High Court here today asked
Principal Secretaries of all departments in Uttar Pradesh to
submit details of government employees who have superannuated
on or before December 31, 2008, but are yet to be paid their
pensions and other post-retirement dues.
The judgement came while hearing a contempt petition
filed by K P Sinha, a retired employee of the state medical
and health department who had alleged non-payment of
post-retirement dues despite an earlier court order to this
effect.
Justice Viram Nath observed that submitting the details
"will not only facilitate payment of post-retirement dues and
pension to retired employees but will also reduce the burden
of the court in various jurisdictions, including that of
contempt, to a large extent".
"Retired employees are entitled, as a matter of right, to
all dues and pension within reasonable time, which is about
six months to a year from the date of retirement," the court
said.
Fixing March 25 as the next date of hearing, it directed
the state's Chief Standing Counsel to communicate the order to
the Chief Secretary of UP so that necessary orders may be
issued to ensure compliance.
