Ahmedabad: An NGO representing some of the 2002 post-Godhra riot victims on Wednesday challenged the Nanavati Commission's order declining to summon Chief Minister Narendra Modi and others in the Gujarat High Court.

A petition by Jan Sangharsh Manch (JSM) sought quashing of the commission's order of September 18 and prayed that Modi and six others - two ministers, three officials of the Chief Minister's Office (CMO) and a police officer - be called for cross examination with regard to the riots that killed over 1,000 people.

The matter is scheduled for hearing in the court of Justice K S Jhaveri tomorrow.

The two-member panel, probing the riots triggered by the burning of Sabarmati Express, had disposed of a JSM application seeking summoning of Modi and others, saying they did not find justification in cross-examining them for the purpose stated by the NGO.

The commission had further said in the order that allegations made in JSM's application were vague and based on wrong or unwarranted assumptions.

It, however, had directed three CMO officials to file affidavits giving details of their telephonic conversation with some of the ministers and riot accused after the train burning on February 27, 2002.
