New Delhi: Delhi police on Thursday sought death
penalty from a court here against two HuJI militants,
including a Bangladeshi national, who have been convicted of
waging war against the country and possessing explosives.
Public Prosecutor Vinod Kumar Sharma argued for the
capital punishment against Mohd Amin Wani, a Jammu and Kashmir
resident, and Lutfur Rahman, the Bangladeshi national who is
alleged to have received training at the instance of
Pakistan-based Jamaat-Ud Dawa chief Hafiz Saeed.
"The convicts were a threat to the security of the
country. They wanted to disturb peace by carrying out terror
activities. They are impediments in the creation of a fear
free society," Sharma told Additional Sessions Judge Nivediata
Anil Sharma during the arguments on the sentence.
He said the extreme punishment would not only teach them
a lesson but would also send a signal to those harbouring
nefarious designs against the country.
Defence counsel M S Khan, on the other hand, opposed the
contention of the prosecution by submitting that the police
had created false evidence like planting of explosives to
ensure conviction of the accused.
The prosecutor, who referred to a news report on a threat
allegedly issued by HuJI against the countries participating
in the upcoming Commonwealth Games, was told by Khan that the
court could not rely upon media report.
Wani and Rehman, arrested from the national capital on
January 4, 2007, were held guilty by the court on February
16.
Wani, 29, was arrested on January 4, 2007, here carrying
Rs 4.5 lakh received from a hawala operative at Seeshganj
Gurudwara in old city area here by the Delhi Police's Special
Cell.
Rahman, 30, was apprehended from Hazrat Nizamuddin
Railway station here with over 1.5 Kg of explosives and a
timer device on the same day on the disclosure of Wani.
According to police, both the convicts were out to
disrupt the Republic Day function.
Both were charged under the various provisions of the IPC
including those relating to waging war against the country and
other offences under the Unlawful Activities (Prevention) Act
and the Explosive Substances Act.
