Kochi, Jan 08: The Kerala High Court on Thursday directed CBI to proceed with the investigation in the sister Abhaya case with determination by the present team under the supervision of DIG Chennai and Joint Director South.
Overseeing of the investigation shall be done by Justice R
Basant.
The order was issued by Justice R Basant on a
clarification petition filed by CBI complaining that there
are contradictions in the directions issued by two benches of
the High Court in the matter of investigations in the case.
Confusion cropped up when the single judge, Justice
K Hema, while granting bail to the three accused in the
case recently, ordered that the present investigation team
would continue, but that the case should be supervised by
an experienced, efficient higher officials of the CBI.
Justice Basant said no specific clarification or further
direction is necessary.The bail bench did not and could not
render any authentic findings on the question that arose in
the investigation. No final opinion on any matter pending
investigation can be or was rendered by the bail bench, court
said.
The observation of the bail bench must persuade and
''alert investigator pointedly considering the relevent
circumstances adverted to in the bail order,'' it held.
Justice Basant also expressed dissatisfaction over
CBI stopping investigation after the single judge's order.
