Madurai: The Madras High court bench here today allowed writ petitions of two candidates who had passed B.A. (Functional English) and B.Ed, seeking to appoint them as Graduate Assistant Teachers and directed the teachers rerucitment board to appoint them as BT assistants
"When the B.A.(Functional English) obtained from a Deemed University is taken to be equivalent to B.A. (English) for appointment of Graduate Assistant, the Member Secretary, Teachers Recruitment Board and other officials could not deny the same benefit to the persons who obtained the same degree from Manomaniam Sundaranar University," Justice D Hariparanthaman said.
He stated this while allowing Petitions of K Chellathai and B Anuradha, who had passed B.A.(Functional English) from MSU
Besides the persons who obtained Functional English degree from MSU were selected as BT Assistants by the second Member secretary of TRB and they were appointed.
The Petitioners submitted their degrees had been recognised as equivalent to B.A.(English)and MSU had also given a certificate to that effect. Hence they were entitled to the appointment.
The Judge rejected the the Additional Government pleader submission that as per G.O., the B.A.Functional English degree of MSU mentioned in the list only were considered as B.A.(English)and not other universities.
However MSU`s counsel said that if the B.A.(Functional English)of Avinashilingam university was equivalent to B.A.(English) there was no reason to deny the same benefit to the students of the MSU.
