HC bars toll plazas on NH-46 to collect extra fee

Chennai: Madras High Court on Monday directed that the enhanced fee at the toll plazas located at Vaniyambadi and Pallikonda on the Krishnagiri-Walajahpet sector of NH-46, should not be collected until further orders.

Confederation of Surface Transport (Tamil Nadu) represented by its president, R Sugumar, submitted that construction of four-lane road on NH-46 had been completed with public funds.

Since the construction of six-lane road and provision of public utilities were not completed, there would be no justification for collecting extra rate of user fee, it was contended.

The Petitioner contended that for other sectors such as Hathipalli-Hosur, Walajapet-Kancheepuram, Kancheepuram-Poonamallee, the user fee was collected as per notifications under 1997 rules. Only the Krishnagiri-Walajahpet sector was discriminated, it was alleged.

Justice P Jyothimani before whom the matter came up ordered status quo as it existed on June 1, 2010 until further orders.
