Madurai: The Madras High Court Bench here has transferred a civil case from Tirunelveli Principal District Munsiff Court (PDMC) to Tuticorin PDMC, following an allegation that one of the litigants was adopting "back door methods" to persuade the Tirunelveli court to hold in his favour.
Justice A Selvam, allowing a petition filed by S Subbiah, said it was possible that the Tirunelveli PDM could hold in favour of the petitioner`s rival by relying on a criminal document that was called for by the PDM from the Pathamadai police station in Tirunelveli.
The petitioner`s rival had produced the document before the PDM on Nov 10, 2009 and it had been taken on file on Jun 8, 2010, the court said. However, the PDM had not insisted on litigant Subbiah to file an appropriate application, seeking permission for filing the same, the court said.
The PDM`s reply to the High Court`s query, seeking explanation, was not acceptable, Justice Selvam said.
He rejected the contention of the PDM that the petitioner did not raise any objection, when the criminal document was taken on file.
"The PDM did not give any suitable remark to the queries of this court," and he had been "evasive" in his replies, the court said.
