Madurai: The Madurai Bench of the Madras High Court on Thursday restrained the Tamil Nadu Electricity Board from providing electricity supply to 23 flats in a private enclave.
Justices R Sudhakar and S Vaidyanathan gave the interim stay on a petition by TR Deivasigamani, President, Shanthi Nikethan Welfare Association, seeking to quash the approval given for the construction of the flats.
The builders had "illegally constructed" the flats in Shanthi Nikethan apartments without obtaining approval from the Local Planning Authority, the petitioner contended.
As per the Tamil Nadu Town and Country Planning Act-1971, Local Planning Authority is the appropriate authority to grant approval. However, the builders had obtained approval from the Madurai Corporation, which was only a supervising and administrating agency, he said.
The approval was illegal and the flats were liable to be demolished by the LPA authorities, the petitioner contended and sought an injunction against the provision of electricity connection to the flats as an interim measure.
