Teachers' pay can’t be governed by labour laws: HC

Chennai: The Madras High Court has held that salaries of school teachers could not be governed by labour laws and quashed two Tamil Nadu Labour department orders.

Partly allowing writ petitions filed by Tamil Nadu Tamil and English Schools Association, Justice T Raja, however, held valid a portion of the impugned government orders in respect of non-teaching staff.

Citing various Supreme Court judgements, the Judge observed that only non-teaching staff of the petitioner schools could be covered by the minimum wages act.

The Judge pointed out that in respect of teachers, the ratio laid down by the apex court clearly showed that the provision of the act could not be applied.
