Lucknow: With a view to restoring the
provisions of anticipatory bail in the state, Uttar Pradesh
government today tabled CrPC (Uttar Pradesh amendment) Bill
2010 in the state assembly.
The Bill for restoring the anticipatory bail provision in
cases, other than henious crimes, was tabled in the House on
behalf of Chief Minister Mayawati.
The Bill is aimed at restoring Article 438 of the CrPC
which was scrapped in the state in 1976.
The provision of anticipatory bail was scrapped during
the Emergency and a high-level committee headed by the state
advisory council set up by the government in this regard had
recently recommended its restoration.
As per the Bill, cases under the SC\ST Act, crimes
entailing capital or life imprisonments besides Gangsters and
Anti-Social Activities (prevention) Act and some other acts
have been kept out of the purveiw of the provision of
anticipatory bail.
The government also tabled separate bills for setting
up five private universities: Babu Banarasi Das University
Bill 2010, Sri Venkateshwara University, Noida, International
University, Monard University and IFTM University.
