Lucknow: Late deputy chief medical officer YS Sachan`s widow Saturday moved a court here opposing the CBI`s closure report in which it was claimed that the officer had killed himself inside prison.
Sachan, who was found dead in a prison under mysterious circumstances on June 22, 2011, was arrested on charges of murdering CMO BP Singh. Singh and another CMO V K Arya were murdered in Lucknow within a gap of six months.
Sachan had allegedly threatened to expose the people behind the murders of two CMOs through a letter written 10 days before his death.
Malti Sachan, in her plea to special judicial magistrate (CBI) Neelmani Kant Tripathi, alleged that her husband was murdered.
The agency in turn sought time to file its reply.
The court gave CBI time and fixed December 15 as the next date of hearing.
Malti in her application claimed that considering the circumstances, in which the body of doctor Sachan was recovered and also the injury marks, prima facie it seemed to be a case of murder, her counsel Shahi told PTI.
"The spot from where the body was recovered no sharp-edged weapon was found which confirms murder," he said.
Malti alleged that the blade, which was recovered by the police after murder, was planted to create suicide theory.
The former Dy CMO`s wife said that after murder the police claimed that a surgical knife was found from the spot, but its recovery was never shown.
She alleged that "the role of then IG prison V K Gupta was suspicious", but CBI paid no attention towards it.
While doctor Sachan was in the jail, he wrote letter to her expressing apprehension that he may be killed, but CBI did not carry out satisfactory investigation on this point, Malti said.
She said that as per the settled legal position priority
should have been given to the initial post mortem report which was not done by the CBI and believing the expert opinion from AIIMS, suicide theory was established.
CBI had on September 28 filed a closure report in deputy CMO Y S Sachan murder case in the court saying conclusive evidence points to suicide.
The 120-page closure report said during the investigation no evidence has come on record indicating death of Dr Sachan in jail on June 22, 2011, to be a homicide.
Further, no evidence pointing towards presence of a second person in the toilet at first floor of jail hospital has come forth during the probe, the report said.
The opinion of the AIIMS doctors said that the cause of the death in case of Sachan was due to hanging associated with multiple suicidal wounds in support by the oral as well as documentary evidences, which came on record during probe, the closure report said.
In its report, the agency said evidence had come on record regarding acts of omission and commission on part of the then warden Pahendra Singh and head warden Baburam Dubey for failing to do actual head count of inmates and to maintain correct entries.
