New Delhi: The dispute where Indian wicketkeeper batsman Dinesh Karthik moved a consumer forum seeking compensation from automobile designer Dilip Chhabria for his failure to refund the booking amount for a sports car worth Rs. 35 lakh has finally been resolved.
Susan Pallikal, in capacity of Dinesh Karthik's manager, wrote a mail to Dilip Chhabria Design Pvt Ltd, saying that the dispute between the two parties had been resolved.
Earlier, according to a report in the Times of India, Karthik, in his petition, said he had booked a DC Avanti car at the Chhabria's Chennai firm dealership by paying Rs. 5 lakh in May 2013. The seller, in return, promised to arrange a test drive by January 2014. The dealer said if Karthik was satisfied with the car after the test drive, the vehicle would be delivered next month. And if it didn't impress Karthik, the booking amount would be refunded.
But the dealer, reportedly, failed to arrange for a test drive within the stipulated time. "Despite reminders, they kept silent on the delivery timeline," Karthik said to the Times of India.
It was only in April 2015 that Chhabria's company responded to Karthik's emails and said the test drive was available only in Pune.
"A consumer cannot be expected to enter any legally enforceable purchase agreement without seeing and assessing the final product, especially for something as big as a car that involves aspects like safety and comfort," said Karthik.
When he test drove the car on May 18, 2015, his expectations didn't match.
According to further reports, on seeking a refund, the seller said it could not repay the amount as he had already taken a test drive. Karthik then sent a legal notice, but the company replied he had signed the terms of the car purchase.
Karthik said the dealer failed to produce a copy of the document which he allegedly signed. He wanted the forum to direct the dealer to refund the booking amount along with interest and pay a compensation of 5 lakh for causing mental agony.
