`File complete chargesheet in Ponty murder case`

Delhi Police was Tuesday directed by a local court to supply the complete documents related to the charge sheet filed against sacked Uttarakhand minorities panel chief S S Namdhari and 21 others.

New Delhi: Delhi Police was Tuesday directed by a local court to supply the complete documents related to the charge sheet filed against sacked Uttarakhand minorities panel chief S S Namdhari and 21 others in the November 17 killing of liquor baron Ponty Chadha and his brother Hardeep in a shootout at a farmhouse here.

Additional Chief Metropolitan Magistrate Mukesh Kumar asked the investigating officer (IO) Jitender Singh to supply the missing documents from the charge sheet by March 5.

"All the accused were produced from the judicial custody. the copy of the charge sheet has been supplied, but as the documents are incomplete, so the IO should supply all the missing documents...," the court said.

The judge`s direction came after counsel for Namdhari and his personal security officer Sachin Tyagi, who have been charged for murder of Ponty`s younger brother, and 9 others, who are in judicial custody informed the court that they have not received the complete copy of the chargesheet.

Meanwhile, the court has issued notice to IO asking him to appear in person on the next date of hearing in the case after the judge noticed that he was not present when the matter was taken up.

Ponty Chadha and Hardeep, who had an alleged property dispute, were killed in a shootout at a Chhattarpur farmhouse in south Delhi on November 17, last year.
Beside Namdhari and Tyagi, the Delhi Police Crime Branch on February 16 had charge sheeted 20 others including Ponty for the offences ranging from attempt to murder, causing grievous harm, dacoity, rioting with deadly weapons, house trespass, kidnapping and illegally confining occupants of the farm house, destruction of evidence etc.

The charge of criminal conspiracy, common intention and
offence under Arms Act have been imposed on all the 22 accused including Ponty to take over the disputed farm house from the possession of Hardeep.

The charge sheet had named Ponty as an accused as he had reached the place of incident in accordance with his "well hatched conspiracy" with Namdhari and others to take the possession of the disputed farm house in south Delhi`s Chattarpur area which was under the custody of Hardeep.
The charge sheet had stated that Ponty and Namdhari were the "main conspirators in armed and forcible dispossession of occupants from farm house No. 42".

Out of 22, who have been charge sheeted in the shootout, charges against Ponty may be abated as he was killed during the commission of the offence.

The court had ordered initiation of proceedings under section 82 of the Code of Criminal Proceedings (CrPC) to declare the eight men, who have also been named in the charge sheet and are wanted for their alleged roles in killing Hardeep, as absconders. For the remaining two the court had issued non-bailable warrants against them.
