Fashion designer is an artist, upholds Bombay HC

The Bombay High Court Monday upheld fashion designer Tarun Tahiliani`s case that he is an artist, for the purpose of claiming exemption under the Income Tax Act.

Mumbai: The Bombay High Court Monday upheld fashion designer Tarun Tahiliani`s case that he is an
artist, for the purpose of claiming exemption under the Income
Tax Act.

Division bench of Justices Dhananjay Chandrachud and
J P Deodhar today dismissed Income Tax Department`s appeal in
this regard.

Tahiliani had sought deduction of the income earned
through foreign assignments under Section 80 RR. He had earned
over Rs 80 lakh in the year 2000 from foreign countries.

Section 80 RR refers to Indian authors, playwrights,
artists, musicians, sportsmen and actors who receive income
from foreign countries.

Under the section, 75 per cent of the total income is
exempted from tax.

Earlier, Income Tax Appellate Tribunal had upheld
Tahiliani`s contention, against which the IT department had
filed an appeal in the High Court. But High Court too upheld
his case.
