7 Rights You Have Against Traffic Challan
Only a Sub-Inspector (SI) or higher-ranking officer has the authority to demand your papers during a traffic stop and you have the right to refuse any demands from lower-ranking officers and can complain to senior authorities if necessary.
Traffic police cannot arrest you or confiscate your vehicle unless authorized by law and they cannot demand pollution under control papers, which is the jurisdiction of RTO officials.
Only certain ranks, including Sub-Inspectors and Police Inspectors, have the authority to collect penalties for traffic violations as per Section 132 of the Indian Motor Vehicle Act.
If caught committing serious traffic violations such as signal breaking, overloading, driving under the influence, or using a mobile device while driving, traffic police have the right to confiscate your license.
