New Delhi, Sept 07: Terming as "unconstitutional act" Governor inviting Samajwadi Party to form government in Uttar Pradesh after the collapse of BSP-BJP coalition, BSP MP Rashid Alvi today said he has filed a writ petition in the Supreme Court praying that the assembly be dissolved.
"I have filed a writ petition in the apex court praying that the state assembly be dissolved because the decision taken by Governor Vishnu Kant Shastri asking Samajwadi Party leader Mulayam Singh Yadhav to form the government is an unconstitutional act," he said here.
Alvi said under Article 174 of the Constitution, the Governor is bound to act in accordance with the advise of the Council of Ministers. The Mayawati ministry had recommended Governor to dissolve the House, he said.
The matter would come up before the court tomorrow when Yadav seeks confidence vote in the assembly.
