New Delhi, Sept 18: In a blow to Delhi Police in curbing the activities of Pakistan-based underworld don Chotta Shakeel in the capital, a city court has acquitted four alleged henchmen of the don who were charged with planning to carry out subversive activities under the explosive substance act six years ago.
"I hold that prosecution has failed to prove its case beyond reasonable doubt against all the accused persons and they are therefore acquitted," Additional Sessions Judge C K Chaturvedi said in a recent judgement.
Acquitting Mohd Azaz alias Raju, Mashqoor Ali, Mohd Tareeq and Tanzeem Mohd, who were arrested from a South Delhi flat in 1997 allegedly with a huge quantity of explosives including RDX, the court said they have been given benefit of doubt as prosecution has failed to gather sufficient evidence against them. The court also observed that non-joining of public witnesses and absence of signature of accused on the seizure memo are sufficient to hold the case doubtful.
Prosecution had claimed that telephone numbers recovered from a booth from where the accused persons used to make std and ISD calls had revealed that they were in contact with Chotta Shakeel who was looking after the business of Pakistan-based underworld don Dawood Ibrahim.
