Allahabad, July 09: The Allahabad High Court today dismissed a writ petition filed by the Union Public Service Commission (UPSC), challenging a Central Administrative Tribunal (CAT) order directing the commission to hold a supplementary examination for English paper for a candidate, who could not appear for that paper due to dehydration on October 20, 2001. The order was passed by a division bench comprising Justice M Katju and Justice R.B. Mishra.

Setting aside the petition, the court concurred with the CAT order and said the tribunal had given its judgement on humanitarian consideration and equity in favour of the candidate.

The court also observed that the English paper is of a qualifying nature and its marks are not added in overall marks obtained by a candidate.
