New Delhi, Feb 17: Comparing Uttar Pradesh MLA Madan Bhaiya with Osama Bin Laden for eluding the state and Delhi Police for the past one year in a murder case, the Delhi High Court today rejected a plea for camera hearing of a writ petition seeking his arrest for avoiding non bailable warrant. "Is he Osama bin laden that he cannot be arrested," a bench comprising Justice Dalveer Bhandari and Justice S K Agarwal asked Additional Solicitor General K K Sud while rejecting a plea by him and Delhi Police counsel for camera hearing of a petition seeking Bhaiya's arrest.
When Sud and Delhi Police counsel Mukta Gupta said they wanted camera hearing because certain steps taken by the police in the case could not be explained in open court for the apparent reason of being reported by media, the court said "media has an important role to play."
As Sud contended that there was "no let up on the part of up police", the court said during the past one year despite its several directions no concrete action was visible.
Delhi police has registered an fir at North-East Delhi's Gokulpuri police station against Bhaiya for alleged abduction and murder of a youth on September 20, 2000.
Despite a city court issuing NBW against Bhaiya, Delhi and UP police have failed to execute the same and produce the MLA before it. Following this, an uncle of the victim had filed a writ petition in the high court seeking execution of the arrest warrant against the elusive MLA.
The court, which on January seven had summoned up DGP to explain the position, exempted him from personal appearance after state police IG P C Sabharwal appeared before it and posted the matter for further hearing on March 23. Bureau Report
