New Delhi, Aug 23: The prosecution in the Maulana Azad Medical College student gangrape case today told a city court that it would not examine a witness after suspecting him to have been won over by the accused. Prosecution told additional sessions judge Deepa Sharma that it was dropping Jaspal - to whom an accused Amit had allegedly given the mobile phone which was snatched away from the victim - as a witness. According to police, Amit gave the mobile to Jaspal as he had taken Rs 500 from the latter. However, Jaspal allegedly returned the mobile to Amit when he received call on that number from persons unknown to him.
Today the prosecution examined two witneses Shamsher and Parth. Both are police personnel.
Replying to the application moved by the defence seeking the summoning of the doctor - who conducted ossification test of prime accused Rahul - as witness, the prosecution said it was their discretion to drop whichever witness they wanted.
The prosecution had dropped Dr Uppal of the Safdarjung Hospital as witness as Rahul's age was already determined by the test.
Rahul and co-accused Amit are in judicial custody. Two other accused are in juvenile observation home while the fifth one - Ashok - arrested for allegedly giving shelter to Rahul has been released on bail.
A week after the sensational incident, Rahul was arrested by police on November 22. The fourth-year student of Maulana Azad Medical College was allegedly raped by three youth at knife point on the terrace of the "Khooni Darwaza" monument on the busy Bahadur Shah Zafar Marg.
