Suspended IPS officer Amitabh Thakur on Monday wrote a letter to the UP govt, stating that his suspension had "legally lapsed" and thus he should be reinstated immediately as per the provisions of the law.

Lucknow: Suspended IPS officer Amitabh Thakur on Monday wrote a letter to the Uttar Pradesh government, stating that his suspension had "legally lapsed" and thus he should be reinstated immediately as per the provisions of the law.

In a letter to Principal Secretary Home, Amitabh said, "With passing of 140 days since my suspension on 13 July and there being no review of the suspension during this period, my suspension has already legally lapsed and I shall be reinstated immediately".

Thakur noted that he was suspended under Rule 3 of the All India Services Discipline and Appeal Rules but as per the sub-rule 8, every suspension order must be reviewed within 90 days of suspension by a Review Committee headed by Chief Secretary and if such review is not done, the suspension order stands automatically revoked.

"I have enough evidence to prove that my case was not reviewed within the prescribed 90 days period, hence instead of undertaking any back-dated exercise, I shall be immediately reinstated on the date when 90 days period was over," Thakur said.

"If I did not get an appropriate order within a week, I will move to Court for judicial relief," he added.

Thakur was suspended after he lodged an FIR against Samajwadi Party supremo Mulayam SIngh Yadav, who allegedly threatened him over phone.
