New Delhi: The Uttarakhand High Court on Tuesday resumed hearing in the disqualification of 9 Congress MLAs case. 

During the hearing on Monday, the Congress MLAs had claimed that their opposition is only against chief minister Harish Rawat and they are with the party if it forms the government under the leadership of any other leader except Rawat. 

MLAs said they never joined or supported BJP and thus they cannot be expelled from the party just because of an “intra party” dissent. 

'Deserting a bad' leader should not be compared to 'deserting the party'. 'What constitutes defection is deserting the party,' said Congress MLAs' counsel, senior advocate CA Sundaram.

After deferring the hearing on Monday, the HC resumed hearing on Tuesday into the petition in which 9 Congress MLAs had challenged Uttarakhand Speakers Govind Singh Kunjwal’s decision to disqualify them under the anti-defection law on March 27.
