Meerut/Lucknow: Just hours after the Supreme Court held the Muslim practice of instant divorce "unconstitutional", "arbitrary" and "not part of Islam", a pregnant woman was allegedly given triple talaq by her husband in the Sardhana area in Meerut, Uttar Pradesh.
The victim has filed a complaint against her husband alleging that her better half beat her up for dowry and drove her out of their house.
She is a resident of Mohalla Kamra Nawaban.
The Police has registered an FIR against the husband.
The woman married the accused six years ago and has three children.
According to police, the woman alleged that she suffered a miscarriage due to the beating.
She said her family told her husband that the Supreme Court had struck down the practice, but he did not relent.
In a path-breaking verdict, the Supreme Court on August 22 banned the 1,400 year-old practice of instant 'triple talaq' among Sunni Muslims and set it aside on several grounds including that it was against the basic tenets of the Holy Quran and violated the Islamic law Shariat.
A five-judge Constitution bench, by a majority of 3:2 in which the Chief Justice JS Khehar found himself in a minority, said in a one line order: "In view of the different opinions recorded by a majority of 3:2, the practice of 'talaq-e-biddat' or triple talaq is set aside."
The Jamiat Ulama-i-Hind has opposed the path-breaking Supreme Court verdict on triple talaq.
Jamiat Ulama-i-Hind described the apex court decision as violative of the "Shariah" and a matter of "grave concern" for the Muslim community.
Taking a defiant stand, Jamiat general secretary Maulana Mahmood Madani said instant triple talaq was still valid as per the Islamic code notwithstanding the Supreme Court declaring it as unconstitutional and void in law.
"Even now, if a man administers instant talaq, it will come into effect as per Shariah for those who believe in it," he told reporters in the national capital.
