Microsoft Corp has asked the federal
judge in charge of consolidating all the third-party Antitrust
lawsuits against the company to summarily dismiss them due to lack of standing, according to the company.
In a 40-page filing in US district court in Baltimore on Wednesday, Microsoft said because consumers purchase its
operating systems through their computer manufacturers or
through retailers, Antitrust law does not apply.
The company asked judge J Frederick Motz to dismiss or
summarily rule in the company`s favour in 62 class-action
cases, the vast majority of which were filed after US district
judge Thomas Penfield Jackson in Washington DC, ruled that the company violated federal Antitrust laws.
Microsoft is appealing Jackson`s ruling and his order to
split the software giant into two separate companies. The US
Supreme Court will decide this fall whether to hear the
company`s appeal or send it to the US court of appeals first.
