Ahmedabad, July 04: A special Pota court today deferred till July 7 its ruling on regular bail application of Maulvi Hussain Umarji, prime accused and conspirator of the Godhra train carnage.
Pota court judge Sonia Gokani deferred the judgement due to some technical problems in computer.
Hearing on the petition had been completed on June 30. Defending Maulvi on behalf of Janhit, an NGO, advocate Mahesh Bhatt had argued that the confessional statement of another accused Zabir bin Yamin Behra, in which he named the Maulvi as the conspirator behind the attack on ‘Kar Sevaks’, did not hold ground as he did not get a direct instruction from the applicant to prepare for the attack a night before the incident.
Bhatt said as per the confessional statement of Behra, he was approached by Farouk Bhana and Razak Kurkur, two other persons of the 'core group' that allegedly torched the S-6 coach of the train, and they said the 'Maulvi' had told him also to be part of the plan. Bhatt, while arguing that the Maulvi was not part of the alleged conspiracy, contested that even the confessional statement did not mention anywhere that his applicant had directly instructed Behra and that it was a case of hearsay.
Umarji, a local cleric in Godhra town was arrested from the sensitive signal Falia locality there in February this year. Bureau Report
