HC dismisses writ challenging dissolution of AP Assembly

writ petition that had challenged the validity of the
dissolution of state assembly on the basis of advice tendered
by the state cabinet on November 14.
Rejecting the writ filed by R Krishnaiah, president,
Andhra Pradesh Backward Classes Association, the bench
comprising Chief Justice Devender Gupta and Justice G Rohini,
said there was no constitutional infraction in the decision of
the government and it had acted perfectly in tune with the
constitutional spirit.
The bench also refused to go into the malafide allegations levelled against Chief Minister N Chandrababu Naidu for the dissolution.
Chief Justice Devender Gupta observed that the decision dissolving the house was a collective one taken by the Council of Ministers which enjoyed absolute majority in the house. The petitioner contended that the Chief Minister mooted the proposal to dissolve the assembly to `encash on the sympathy` generated among the people in the aftermath of the assassination bid on him at Tirumala on October 01 last.
