New Delhi, Oct 29: The Delhi High Court today held that the prosecution evidence based solely on lecturer S A R Geelani's telephonic conversation with other militants involved in Parliament attack case was not enough to convict him with the conspiracy charge. "We have pondered over this evidence (telephonic conversation between Geelani and two convicts), it is a relevant circumstance but by itself without anything more on record is not sufficient to draw an inference against S A R Geelani that he was involved in the conspiracy," a bench comprising Justice Usha Mehra and Justice Pradeep Nandrajog said while acquitting him.
Accepting the prosecution contention that the two Jaish-e-mohammed militants Mohd Afzal and Shaukat Hussain Guru were known to Geelani and used to remain in contact with him over telephone, but the bench said, "There is, however, no evidence on record to establish that he (Geelani) remained in touch over the telephone with the terrorists."
"When one acquires a mobile phone, it is but natural that one would test it for use. What other number would one connect other than that of known person," the court observed adding that "by itself, with nothing more, we are afraid that conviction cannot be sustained on this evidence".
Prosecution had alleged Geelani was in touch with the two accused which was prima facie an evidence of his being a co-conspirator.
