New Delhi, Sept 03: The Delhi High Court today reserved its order on CBI's plea for canceling the interim bail granted to former judge Shameet Mukherjee in the DDA scam case after hearing the accused. This is the second time that Justice S K Agarwal reserved its order on the CBI's plea for cancellation of Mukherjee's interim bail and the accused's application for regular bail. Earlier, he had "reserved" his order in the matter on August 28. However, five days later he decided to hear the accused before giving the verdict.
Mukherjee's counsel D C Mathur submitted before the court that there was no evidence to prove that the accused received any pecuniary benefits from other co-accused.
When the court asked if Mukherjee's being allegedly entertained by wine and women at the behest of co-accused Dharambir Khattar at his "costs" did not amount to pecuniary benefits, Mathur answered in the negative.
He also questioned the authenticity of the statements of certain witnesses recorded by CBI, saying the agency had failed to give date and time of the alleged incident of their having been approached on behalf of the accused.
The CBI has sought cancellation of former judge's bail accusing him of trying to tamper with evidence and influencing a prosecution witness through two advocates thereby violating interim bail conditions imposed on him by the court. He should be remanded back to judicial custody after canceling his interim bail, it said.
