Mumbai HC orders police to take custody of Dawood Ibrahim`s brother
Mumbai, Sept 05: The Mumbai High Court today allowed police to take the custody of Iqbal Hassan Ibrahim Kaskar, younger brother of underworld don Dawood Ibrahim, and two others in a case of alleged extortion and land grabbing for three days.
Mumbai, Sept 05: The Mumbai High Court today allowed police to take the custody of Iqbal Hassan Ibrahim Kaskar, younger brother of underworld don Dawood Ibrahim, and two others in a case of alleged extortion and land grabbing for three days.
However, Justice V M Kanade stayed his order to enable the accused to file an appeal.
Iqbal Kaskar, Abdul Rehman Abdul Gafoor Shaikh and Abdul Sattar Haji Hiva Randhanpur had filed petitions challenging a lower court order which remanded them to police custody from May 6 to 8.
The accused were held in judicial custody and the court's order granting them remand in police custody. They argued that police custody could not be given after 30 days of arrest in keeping with Anupam Kulkarni judgement of Supreme Court.
They are facing the charge of forcibly evicting a woman from her house which had obstructed the entrance of a shopping centre allegedly owned by Dawood Ibrahim and his associate Chhota Shakeel in South Mumbai.
The trial court had earlier attached Sara Shopping Centre and Sahara Shopping Complex allegedly owned by Dawood and also appointed court receiver in respect of these properties. About 350 tenants had moved the court to challenge the order of attachment and appointment of court receiver.
