Ahmedabad, Nov 04: The special Pota court today rejected the bail application of four accused in the Godhra train carnage saying there was enough evidence to establish their presence at the site of incident when a coach of Sabarmati Express was torched. Rejecting the bail application of the four, Pota judge Sonia Gokani also that the evidence on their presence "was also testified by several witnesses". The prosecution led by additional public prosecutor Sudhir Brambhatt had also contented that the accused persons had conspired to "strike terror in the minds of a section people" and were charged under Section 120 (B) CRPC. Two of the accused Muzaffar Usman Hayat and Ahmed Abdul Rahim Kala were arrested by the special investigating team of the CID (Crime) of the railway police on July 25 last year and on March 14 last year respectively.
The other two, Mohd Sayed Abdul Salam Badam and Shabbir alias Bhupatno Bhurio were arrested on April 10 last year and September last year respectively.
The Pota court also found a prima facie case against the four accused and admitted the prosecutions argument to reject their bail plea in order to protect several witnesses who have testified about their presence among the mob that allegedly torched the S-6 bogey of the Sabarmati Express train on February 27.
