New Delhi, May 28: Sacked DDA commissioner (planning) Vijay Rishbud and DLF employee Ajay Khanna, facing charges in a DDA scam case, were granted bail by a CBI court here today. However, special judge Prem Kumar declined to enlarge two other accused private builder G R Gogia and modern public school society director Amrit Lal Kapur after the agency expressed apprehension that they might tamper with evidence.
The court granted bail to Rishbud and Khanna as CBI conceded it would not be able to chargesheet them within 60 days of their judicial remand.
Under the proviso of Section 167(2) of Cr.P.C, an accused arrested for an offence punishable with imprisonment up to seven years, is entitled to bail, if the prosecution fails to file the chargesheet within 60 days.
The court asked Rishbud to furnish a personal bond of Rs one lakh and surety of like amount and fixed Khanna's bail amount at Rs 2 lakh with one surety of like amount.
While Rishbud has been in judicial custody since April 15, Khanna is in jail since April 10.
The special judge also directed the duo to surrender their passport and desist from tampering with evidence or contacting the witnesses in the case.
The court took note of the fact that three co-accused have been granted bail by the High Court on this ground.
Rejecting Gogia's bail plea, the court said the accused cannot be granted the concession given to Rishbud and Khanna as he has been in judicial custody only for 41 days now.
