Siwan, Aug 08: A local court today ordered attachment of the property of fugitive RJD MP Mohammed Shahabuddin for evading arrest in a kidnapping case for a long time but refused police appeal for impounding the MP's passport.
Siwan Chief Judicial Magistrate (CJM) Sushil Kumar Sinha, who had adjourned the case asking for relevant papers yesterday, accepted police's plea and allowed attachment of Shahabuddin's property for evading arrest.
On August 1, The CJM had turned down the plea of Investigating Officer (IO) of the case, Shivnath Chaudhary, for attachment of the MP's property but had allowed the police to publish a written proclamation asking him (Shahabuddin) to appear before the court in a month's time from the date of issuing of the proclamation under Section 82 of CRPC.
Shahabuddin's counsel Ishtdeo Tiwari referred to the CJM's earlier order but the court did not entertain his argument and allowed attachment of MP's property.
The CJM, however, refused the police's appeal for impounding Shahabuddin's passport and said that the IO should verify the particulars of the passport.
The IO had filed an application for seizure of Shahabuddin's passport on August 6 in view of the apprehensions voiced by Director General of Police D P Ojha that the legislator might flee the country.
