Washington, June 27: A US appeals court today overturned a lower court's decision that would have required that Microsoft to carry Sun Microsystems' Java language in its Windows operating system.
Including Java in Windows would make it easier for consumers to access web pages that require Java to run properly, such as online games. Sun had claimed Microsoft used its dominant position to promote its own rival system called .Net.
Sun alleges that the Microsoft's abuse of its monopoly position -- which resulted in a finding against Microsoft -- irreparably harmed Java and hampered its ability to compete with competition emerging from Microsoft's .Net framework software.
Sun's case is one of a number of private antitrust lawsuits that build on the Department of Justice's case, in which Microsoft was found to have abused the monopoly Windows has in the market for personal computer operating system software.
