Court rejects Raja Bhaiya`s plea to attend Assembly
Lucknow, Sept 06: A special court today rejected the plea of jailed independent Uttar Pradesh MLA Raghuraj Pratap Singh, alias Raja Bhaiya`s seeking permission to attend the ongoing assembly session.

Rejecting the application, Special Judge Gangster Act
R A Kaushik observed here that the state had in March this
year issued an order saying that Raja Bhaiya was not to be
shifted from the place of his detention till further orders.
This order of the state of Uttar Pradesh is still in force and is not reported to have been withdrawn till date. The court further observed that in view of the apex court ruling in Ananda vs state of madras that no MP. Has a legal right to attend the Parliamentary roceedings as long he is in judicial custody.
A person in judicial custody can be shifted to only police custody and none else. On these two grounds the special judge rejected the application of Raja Bhaiya even though his petition was not opposed by the state.
