New Delhi, Apr 16: CBI today told a Delhi court that Dharambeer Khattar, arrested for his alleged role in the DDA scam, was not cooperating with its investigations even as the judge questioned the probe agency's conduct for 'failing' to arrest some persons named in the FIR. "The accused is not coming out with truthful statement of facts on the material points and is deliberately avoiding the questioning on the conspiracy angle in the case and recovery of the tainted money," CBI told special judge Prem Kumar while seeking Khattar's judicial custody. Khattar, who was in CBI custody since April 14 had complained of chest pain yesterday and was shifted to AIIMS, agency's counsel Sunder Lal said adding he could not be interrogated properly. Meanwhile, the court questioned the conduct of the agency for failing to arrest some persons named in the FIR relating to a conspiracy to provide undue favours to DLF Universal Ltd. The judge then directed the investigating officer, who stood fumbling for words, to bring the official supervising the probe to the court to explain the anomaly.

Later, a metropolitan magistrate visited AIIMS and remanded him to judicial custody for two days.

Khattar was arrested on April 8 on charges of conspiring with former DDA vice-chairman Subhash Sharma, commissioner (land disposal) Anand Mohan Sharan, commissioner (planning) Vijay Risbud and director (land) Jagdish Chander to grant floor area ratio to DLF by charging them below market rates.

Rishbud and Chander, whose CBI custody ended today, were produced in court and remanded to judicial custody till April 30.
