New Delhi, June 13: The Delhi High Court today pulled up CBI over its unpreparedness to state the stage of investigation in the DDA scam case even as it granted bail to two accused and extended the interim bail of another.
Justice S K Agarwal expressed his anguish against the investigating officer for his failure to reply to queries including that on the stage of investigation while hearing the bail petition of DDA's suspended vice-chairman Subhash Sharma, who is one of the accused in a case involving former high court judge Shameet Mukherjee.
The other accused in the case are alleged middlemen Dharma Bir Khattar, his brother Devinder Khattar and hotelier Vinod Khatri.
The court after hearing the arguments of the counsel of Sharma, Dharam Bir Khattar and Khatri adjourned for Monday.
CBI counsel R K Dutt told the court that the agency would oppose their bail on merits of the case.
Sharma and Dharam Bir Khattar have been named as accused in all the four FIRs registered by the agency in the DDA scam.
Seeking bail of Sharma, his counsel K T S Tulsi said that the accused (Sharma) has been in jail for more than 60 days since he was arrested on April 4 on the basis of the first FIR registered against him.
The counsel submitted that though Sharma was again arrested on May 7 on basis of the fourth FIR registered on April 29, the number of days in custody will be counted on the basis of the first FIR as the allegations in all the cases were similar, i.e of conspiracy.
