Chennai, Oct 06: As Tamil Nadu Chief Minister, J Jayalalithaa awaits the Prime Minister's response, the BJP today opposed the state government's move to arrest Union Minister, M Kanappan under Pota saying it would be "misapplication of the act." BJP President, M Venkaiah Naidu told reporters that invoking Pota against Kanappan was "unnecessary." The BJP chief said that taking action under Pota against the minister would be a "misapplication of the act" as was done in the case of Vaiko. Naidu also demanded an amendment to Pota to make it obligatory on the part of the state governments to accept the recommendations of the Pota review committee.
He said that at present the recommendations of the committee were only of an advisory nature and not binding on the state governments.

" If the recommendations were to be implemented, an amendment to the act was necessary," Naidu said.
