CBI urges court to try Ejaz Pathan with 122 other accused
Mumbai, Mar 27: CBI today urged a special court to try prime accused in the 1993 bomb blast case Ejaz Pathan along with 122 other accused, including actor Sanjay Dutt, saying that he was part of the same conspiracy that led to the serial explosions here on March 12, 1993.
Extending judicial remand of Pathan till April 16, the court directed CBI to file submissions justifying their stand to join Pathan in the same trial along with other accused.
Defence lawyers Abbas Kazmi and Farhana Shah said that they would take a stand after CBI files written submissions.
After hearing arguments from both sides, designated judge P D Kode would give his ruling on whether Pathan should be
tried along with other accused or face a separate trial.
CBI lawyer S Natrajan argued that Pathan had already made a confession and that the offence allegedly committed by him was part of the same conspiracy hatched by Pakistan-based don Dawood Ibrahim to trigger serial explosions.
Therefore, he should be tried in this case along with others and not separately, CBI argued.
On March 24, CBI had filed a supplementary chargesheet against Pathan. On the same day, he retracted his confession recorded by CBI on the ground that it was not voluntary.
CBI has charged Pathan with taking active part in a conspiracy meeting called by underworld don Dawood Ibrahim in Dubai prior to the bomb blasts in March 1993.
In this meeting, plans were hatched by the accused to send arms and ammunition to india and distribute them to carry out terrorist acts in Mumbai and elsewhere, CBI alleged.
