Raipur, Aug 11: Chhattisgarh unit of BJP today demanded the resignation of Lokayukta Justice K M Agrawal alleging that his appointment by the state government was illegal, even as the government justified its stand. Since Justice Agrawal has retired from the Central Administrative Tribunal (CAT) as chairman, he is not eligible for any post under state or central government as per the administrative tribunal act-1985, Chhattisgarh BJP legal cell President D D Shukla said in a statement here today.
As per the section 11(a) and (b) of the act, Justice Agrawal's appointment is against law hence he should resign from the post on his own to maintain high legal morale or else BJP would challenge his appointment in the court of law, Shukla said.
However, an official spokesman stated that Justice Agrawal's appointment was done as per law and similar examples were available in other parts of the nation. Before his appointment of August 2 last, it was verified whether section 11 of the act is applicable or not and was found that his appointment is totally legal, the spokesman said.
Justice Agrawal was sworn in as the principal Lokayukta on August 6 by the state governor Dinesh Nandan Sahaya at Raj Bhawan here. Bureau Report
