Sessions court Judge P B Desai has fixed the matter for
hearing on October 24.
Appearing for Sarabhai, advocate R K Shah told court that there has been no criminal offence committed as alleged in the complaint as "nothing of this sort was found in the probe conducted by the charity commissioner and joint commissioner of police after the complaint was lodged against her."
On the contrary, some of the members of the dance troupe told the Joint Commissioner of Police that they have no grievances (against Sarabhai), Shah said.
Also, all the payment of Rs 3.15 lakh except for the non-refundable amount of Rs 20,000 has been refunded to the members of the dance troupe, Shah contended.
The city police had on October 18 initiated an inquiry into Sarabhai's alleged involvement in a visa racket after one Manushree Shah lodged a complaint alleging that she was not refunded a sum promised to her.
Shah had alleged that she had been defrauded by Sarabhai for not taking to united states along with a dance troupe as promised a year ago and that Rs 20,000 out of the Rs 3.15 lakh paid was yet to be refunded.
A case has been registered against Sarabhai under Section 420 (cheating), 120 (concealment) and 409 (criminal breach of trust) of the IPC against her at the Naranpura police station.
The danseuse had dismissed the allegation as baseless saying there was no "iota of truth" in them.
