New Delhi, May 30: Stung by the use of its trade mark "Yahoo" by an Indian company involved in the business of food and mineral water, Yahoo Inc today approached the Delhi High Court and succeeded in restraining it from using its popular brand name.
The leading internet service provider approached the court alleging that Nashik-based Mayaram Food Ltd (MFL) has robbed it of its trade mark "Yahoo" to promote its wafers, mineral water and other confectionery products.
Recognising the global reputation of the American internet company, justice Manmohan Sarin in an ex-parte order said "Yahoo Inc has made out a good prima facie case for the grant of an ad interim injunction".
The court restrained MFL, its proprietors and agent from manufacturing and selling wafers, mineral water or any other product by using the brand name Yahoo.
Yahoo's counsel V P Singh and Pravin Anand had alleged that the Indian company illegally adopted the similar brand name to encash the trans-border reputation of the internet company to pass off its goods as those of the American company which has ventured also into non-computer business.



To stop the wafer company from using its brand name, the counsel said Yahoo Inc had licenced the "Yahoo" mark for use in connection with candies, chocolates, mints, ice cream etc pursuant to co-branding agreements with reputed multinational firms.



They said the internet company was informed about the misadventure of MFL in September last and while investigation in this regard was undergoing it came to their notice that Nashik-based company has applied for registration of Yahoo as trade mark.
