Kanpur, Sept 05: A special court will hear on September 11 the government petition seeking withdrawal of Pota cases against independent MLA Raja Bhaiya, his father and another legislator.
The petition which was to come up in the Pota court today could not be taken up as the Judge Shailendra Saxena adjourned the hearing due to absence of Raja Bhaiya and MLC Akshay Pratap Singh, who are admitted to a hospital in Lucknow.
The Judge said the hearing would take place only when all accused appear before the court.
Only Raja Bhaiya's father Udai Pratap Singh was present in the court. He was brought here from Pratapgarh district jail.
The Judge rejected Raja Bhaiya and Akshay Pratap Singh's pleas for exemption from appearing in the case and instructed Chief Metropolitan Magistrate G S Dube to probe under what circumstances they were shifted to hospital.



On an application moved by lawyers opposing withdrawal of Pota case against the three, the Judge asked the applicants to state the locus standi on which they were opposing it.
