Mumbai, June 09: On a CBI plea, a special court today summoned three witnesses to depose on June 11 with regard to evidence against 1993 bomb blast accused Ejaz Pathan.
The witnesses are the immigration officers, who confronted Pathan when he was deported from Dubai recently.
On May 28, the court had rejected Pathan's plea to recall all the 684 witnesses on the ground that he had no legal right to summon them as he had been absconding for the last ten years when the evidence was being led by CBI.
Designated judge P D Kode, however, allowed CBI to recall two witnesses who had recorded the statements of Pathan in their capacity as investigating officers.
CBI has charged Pathan with taking active part in a conspiracy meeting called by underworld don Dawood Ibrahim in Dubai prior to the bomb blasts on March 12, 1993.
In this meeting, plans were hatched by the accused to send arms and ammunition to India and distribute them to commit terrorist acts in Mumbai and elsewhere, CBI alleged.
CBI alleged that Pathan had sent co-accused Manoj Kumar Bhanwarilal Gupta alias Munna, Ethesham, Shahnawaz Khan, Akbar Abu Sama Khan and Karimulla to help prime accused Tiger Memon in landing of arms and ammunition at nearby Raigad Coast.
CBI also charged Pathan with sending co-accused Shaikh Mohammed Ethesham Haji Gulam Rasool Shaikh, Sultan-e-Rome Sardar Ali Gul and Shahnawaz Khan Faiz Mohammed Khan to Pakistan enroute Dubai for arms training.
Pathan carried a reward of Rs five lakh on his head. On March 24, CBI filed a chargesheet against him. On the same day, he withdrew his confession recorded by CBI saying that it was not voluntary.
