Allahabad, Oct 21: Observing that the Gangsters Act was being frequently misused in Uttar Pradesh, the Allahabad High Court today directed the Director General of Police and the Principal Secretary (Law) to appear before it on October 30 to explain the misuse of the law in the state. There is some political interference in the activities of the police or otherwise some malpractices are prevaliling in the use of this act, a division bench, comrpising Justice S K Agrawal and Justice K N Sinha, observed.

The judges said they intended to impose heavy cost on police officers abusing the process without giving show cause notice before slapping gangsters act on a person. "A sorry state of affairs is prevailing in the state for quite sometime and now we find that the provisions of the UP Gangsters Act are frequently misused," they bench said, staying the arrest of one Amarnath Dubey, a resident of Mirzapur district, in a case registered against him under the UP Gangsters Act and Anti-Social Activities (prevention) Act.

The bench said, "We have directed the two officials to be present in the court on the next date with a view to solving the problem of misuse of Gangsters Act we are also intending to impose heavy cost on police officers who are abusing the process without giving show cause notice." "If we find gross abuse of application of the Gangsters Act or Goonda Act provisions, we may take serious view of the matter," the bench said.
