Pota court rejects discharge application in Pandya murder case
Ahmedabad, Oct 10: The special Pota court today rejected an application filed in the Haren Pandya murder case to discharge the charges framed against two Hyderabad-based persons allegedly accused of `harbouring` the prime accused and sharp shooter Asghar Ali.
Ahmedabad, Oct 10: The special Pota court today rejected an application filed in the Haren Pandya murder case to discharge the charges framed against two Hyderabad-based persons allegedly accused of `harbouring' the prime accused and sharp shooter Asghar Ali.
The Pota court today rejected the application and said that 'adequate grounds presented by the prosecution and evidence gathered against the two accused persons by the investigating agency indicate that charges under Section 212 of IPC can be framed even without considering the implication of Pota as the order on that application was pending'.
Pota judge Sonia Gokani had on October 5 itself heard arguments of both the CBI counsel and the defence advocates and had reserved her orders on the matter.
Pota court's orders on another application is also pending for October 17 in which the defence advocate has challenged the application of the anti-terror law on all the 19 persons accused in Pandya's murder case.
Defence advocate Hashim Qureshi had argued that the charges framed against the two persons Sayed Iftekar and Mohammed Abdul Bari were baseless as the former had no knowledge of the motives of Ali and his role in the BJP leader's assassination.
