A local court has adjourned to September 10 the anticipatory bail plea of a sub-inspector who feared arrest in a 1997 case involving police firing on a mob following desecration of Dr B R Ambedkar's statue resulting in the death of ten persons.
The hearing was adjourned yesterday by acting principal sessions judge A J Dholakia after prosecution sought time to seek instructions from police whether custodial interrogation of Manohar Kadam was necessary. Additional public prosecutor M H Sawant assured the court that Kadam would not be arrested until then.
The crime branch had registered a case against Kadam under Section 304 IPC for ordering the police firing at Ramabai Nagar in suburban Ghatkopar on July 11. The Justice S D Gundewar Commission of inquiry, in its findings, said the firing was unwarranted. Kadam was suspended from service but reinstated later.
Kadam's lawyer Rajendra Shirodkar submitted that his client, who had led 20 cops of state reserve police force on that day, had acted in the course of his official duty because the mob would have set afire two tankers stationed nearby. He also referred to a report of National Environment and Engineering Research Institute (NEERI) which said that great devastation would have occurred within 100 metres if the tankers had caught fire.
