Thane: The Food and Drugs Administration of Maharashtra`s Konkan division has issued notices to more than 80 newspapers for publishing advertisements about medicinal products that make tall claims regarding their effectiveness, a top official said on Friday. The advertisements talk about the products which claim of curing sex-related diseases. "Besides serving notices on as many as 80 publications from across the state, the agency has filed a case against drug manufacturer Aryan Ayurved, based in Vasai, for giving misleading advertisements regarding Perfex Herbal Oil and Capsules and also seized products worth Rs 15 lakh from its factory while cancelling licenses of eight such products," FDA Joint Commissioner for Konkan division ST Patil told a news agency.
The case has been filed under various sections of the Drugs and Cosmetics Act and Rules, 1945, Patil said.
The agency has prosecuted 11 manufacturers of such products and has filed an FIR against nine others for making false claims in their ads. Further legal action will follow after the police file a report in this regard, he said.
"The FDA will make use of the provisions under the Drugs and Magic Remedies (Objectionable Advertisements) Rules, 1955 and take action against the erring manufacturers," Patil added.
Explaining the agency`s stand, the officer said the notices were issued against newspapers publishing such ads in order to trace the manufacturers or persons who make such claims.
