Sons to be booked for allegedly beating up mother
Delhi court asked police to lodge FIR against two men for allegedly looting their mother`s ornaments and beating her up, leading to her death.
New Delhi: A Delhi court has asked police to lodge a criminal case against two men for allegedly looting their mother`s ornaments and beating her up, leading to her death ten days later.
Directing Harsh Vihar police station in-charge to lodge a First Information Report (FIR) against the two brothers and their five alleged accomplices, Additional Sessions Judge Nisha Saxena asked police to conduct a probe to verify the allegations.
The court`s order came on a plea by men`s sister Krishna, who had come in appeal to the sessions court challenging a magisterial court order, which had dismissed her complaint against her brothers and five others.
"I am of the opinion that at this stage without conducting a proper investigation, the version of the complainant cannot be disbelieved in view of the documents placed on record. A proper investigation needs to be conducted to find out the truth behind the allegations," said the ASJ, setting aside the magisterial court`s order.
"The revision petition is allowed and SHO PS Harsh Vihar is directed to register FIR under appropriate section of law without being influenced and take up an independent investigation," ASJ Saxena said.
In her complaint, Krishna had accused her brothers and five others, including the wife and the son of one of her brothers, her uncle, brother-in-law of one of her brothers and a servant of assaulting and robbing her mother.
She had alleged the seven had forcibly entered her mother`s house on May 6 last year, and had looted Rs one lakh in cash, besides gold and silver ornaments, after assaulting her.
She had said her mother died barely ten days later on May 16, 2011, succumbing to the injuries sustained in the assault by her sons and others.
On men sister`s plea, the public prosecutor, however, had contended that there was no illegality in the magisterial court order and that their mother had died a natural death.
The public prosecutor had added that the complaint was ill motivated as there are multiple litigations between the parties. Krishna, victim Harbati`s daughter, had said her parents were living with their younger son as their elder sons (the accused here) were not looking after them. The late Harbati had also disowned her elder sons from her will and had bequeathed her property to her younger son, Krishna had said in her complaint adding that the dispute over property was the reason why her mother was assaulted.
