Bakery accused urges for dismissal of special leave petition
Vadodara, Oct 14: One of the twenty-one accused in the Best Bakery case has urged for dismissal of the special leave petition filed by Citizens for Justice and Peace and others in the Supreme Court saying the petitioners, including National Human Rights Commission (NHRC) did not have a locus standi to file the instant writ petition.
Vadodara, Oct 14: One of the twenty-one accused in the Best Bakery case has urged for dismissal of the special leave petition filed by Citizens for Justice and Peace and others in the Supreme Court saying the petitioners, including National Human Rights Commission (NHRC) did not have a locus standi to file the instant writ petition.
The accused, Mahendra Jadhav stated this in the affidavit
in the apex court on October 9, a copy of which was made
available here today.
Jadhav denied various submissions made by the petitioners saying "no question of law arises in this petition or as required under Article 136 of the Constitution of India".
Jadhav quoted the judgement of the apex court in the case of Janata Dal vs H S Chaudhary (1991) 3SCC 756 which has gone to the extent of holding as under:
"Even if there are a million questions of law to be deeply gone into and examined in a criminal case of this nature registered against specified accused persons, it is for them and them alone to raise all such questions and challenge the proceedings... And not for third parties under the garb of public interest litigants," the affidavit said.
